In a recent development, the U.S. Securities and Exchange Commission (SEC) has provided clarification regarding its high-tech export control policies, specifically under ECCN 3A090. Addressing the ban on NVIDIA's GeForce RTX 4090 graphics card stipulated in section 3A090b, the department has granted certain exemptions.

The GeForce RTX 4090 graphics card has received the green light for retail sales in the consumer markets of China, including regions of Hong Kong and Macau. However, a clear restriction remains: the import of RTX 4090 chips for commercial and manufacturing purposes is still prohibited. This means Chinese manufacturing plants will not be able to produce the GeForce RTX 4090.

To the extent that a customer requires products covered by the new licensing requirements, the Company may seek a license for the customer but has no assurance that the USG will grant any exceptions or licenses, or that the USG will act on the request in a timely manner.

Despite this limitation, gamers in China should still be able to purchase the new RTX 4090 card for personal use. This decision strikes a balance between preserving technological advantages and catering to consumer demands.
